  • A mother whose 20-month-old daughter drowned in a neighbor’ above-ground swimming pool can’t sue a township official who approved the placement of the pool’s access gate system, a Commonwealth Court panel has decided.

    The bottom line is that Jeff Richardson, Coolspring Township’s building codes inspector, is immune from Anna Oakes’ complaint because he’s a government employee, Judge Michael H. Wojcik concluded in the state court’s opinion.

    The case centers on what happened in the Mercer County community on April 20, 2016. Oakes’ daughter, Pheylan Marie Cline, got through two gates that were supposed to prevent easy access to the pool, fell in and drowned.

    Oakes claimed in her lawsuit that Richardson was negligent in allowing the pool owner to install two security gates that both opened toward the pool. She insisted the gate setup violated state building codes.

    “Oakes’ theory of liability is that the improper gate configuration allowed Decedent access to the neighbor’s swimming pool, which led to her tragic death,” Wojcik wrote in upholding a county judge’s dismissal of the case.

  • A 32-year-old man is facing charges of burglary and animal cruelty after police said he broke into his ex-wife’s house and killed her dog.

    The Rochester Police Department said Octavio Antonio Nique was arrested July 8 after reportedly breaking into his ex-wife’s house in the 1300 block of 24th Street NW.

    RPD said a neighbor called to report the doors of the house being open. Upon arrival, police said they discovered damage to the inside of the house. The ex-wife was reportedly not home at the time. When they went to the backyard, police said they discovered a deceased pit bull mix dog floating in the above ground pool.

  • One of London’s most popular set of outdoor pools has reopened to swimmers again after closing for months during the coronavirus lockdown.

    Hampstead Heath men’s, ladies’ and mixed bathing ponds, as well as the nearby Parliament Hill lido, reopened for early-morning swimmers on Saturday after the Government said outdoor pools could reopen from July 11.

    City of London Corporation, which manages the pools, said lifeguards have been trained to keep to social distancing rules if they need to assist swimmers in the water.

    The corporation added that if the new early-morning sessions run safely, extra swimming sessions will be added.
