Each state and territory in Australia have swimming pool laws and legislations in place, however they vary depending on which state you live in. This is what you need to know about Brisbanes pool safety and planning laws.
Before any work starts, it needs to be approved for construction by your local council. What’s involved?
Depending on your site you may need to apply for a:
- Building permit
- Sewerage and water supply approval
- Structural Stability approval
In most cases, your pool builder will do this on your behalf and the process is straightforward. Once your approvals have been granted your pool can be built. All residential swimming pools in Queensland must be registered with QBCC (Queensland Building and Construction Commission). Failing to comply can lead to a fine being issued. Additionally, you should check with them that the pool builder you are hiring is licenced. Your pool builder will write up a domestic contract and you should read this thoroughly to ensure you agree to the terms stated before signing. If you agree with the terms outlined, you and the pool builder will then sign the contract and it will be legally binding. No construction can commence until this is done. All swimming pools with a depth of more than 30mm or can hold a capacity of 2000 litres must be enclosed with a compliant pool barrier and it must meet state government pool safety legislation under chapter 8 of the Building Act 1975. It is your responsibility as a pool owner to ensure that your barrier is maintained and there are no objects near the pool that could be used by a child to gain access to the pool. Your pool fencing will be inspected by the council to ensure it is compliant.
